An accredited provider of certification services – conditions for licensing

This document refers to the conditions for granting accreditation to operate as an accredited provider of certification services and other information about the licensing procedure.

Conditions for granting a licence

The person must be qualified or shall perform these activities via a qualified employee. Qualifications means a university degree in an accredited Bachelor’s or Master’s degree program and 3 years’ experience in the field of information technology, or secondary education and 5 years of experience in the field of information technology, including 1 year in the provision of certification services.

Application requirements

In the application for accreditation under paragraph 1, the applicant must show, in the case of a legal entity, the company name, registered address, or the address of a branch of a foreign entity in the Czech Republic, and the identification number of the applicant, if assigned; in the case of a natural person, the name or names, surname, perhaps a supplement, place of establishment, place of business if different from the place of establishment, and the identification number of the applicant, if any.

Annexes:

  1. proof of authorization to conduct business activities; persons registered in the Commercial Register must also provide an extract from the Commercial Register not older than 3 months
  2. material, personnel and organizational prerequisites for the activities of a qualified provider of certification services
  3. information about what qualified certification services the applicant intends to provide
  4. proof of payment of the administrative fee of 100,000 CZK
  5. proof of having a secure system
  6. proof of the security management of trusted systems
  7. proof of introducing and implementing an information security management system
  8. proof of sufficient financial resources and financial security
  9. qualified system certificate for verification

Procedure for granting a licence

  • The applicant shall send the application for the grant of accreditation to the Ministry of Interior of the Czech Republic. The procedure will proceed in accordance with the Administrative Procedure Code.

Application clearing deadline

  • 60 days after the date on which the pertinent authority received the application, including annexes.

Fees

  • CZK 100,000

Validity period of licence

  • Period of validity is not determined.

Authorisation granted by expiration of deadline period

  • Authorization according to deadline will not be used in this process. The services of an accredited provider of certification services can only be provided on the basis of a “Decision on granting accreditation to operate as an accredited provider of certification services”.

Legal Regulation

  • Decree No. 378/2006 Coll., on the procedures of qualified providers of certification services, on the requirements for the tools of electronic signatures, and on data protection requirements for creating electronic tags (the decree on the procedures of qualified providers of certification services).

  • Directive of the European Parliament and Council 99/93/EC of 13 December 1999 on a community framework for electronic signatures.
