Conditions for granting a licence

The licence may be granted to a natural and legal person or business entity that has appointed an entrusted representative, provided that the commercial natural entity or the entrusted representative fulfil the condition of:

  1. Adult age
  2. Full legal capacity
  3. Secondary education with a school-leaving examination in the field of forestry, higher vocational education in forestry or university education in a bachelor’s study program, field of study forestry and professional experience of at least 5 years or a university education in a master’s degree program, field of study forestry engineering and professional experience of at least 3 years

The condition of good character for the purposes of Act No. 149/2003 Coll., is met by a natural person who has not been convicted:

  • for an intentional crime, the facts of which are related to entrepreneurship
  • for a criminal offense committed through negligence, the facts of which are related to the subject of the requested license unless it looks as if he had not been convicted

The Ministry of Agriculture, which decides on granting the license, requires an extract from the Crime Register for the validation of good character.

Application requirements

A natural person shall include in the application:

  1. The name and surname, date of birth and birth ID number if applicable, place and region of birth, place of permanent residence or place of business if different from the place of permanent residence
  2. Trade name or brand, provided the business is conducted under this name
  3. Identification number, where available
  4. Indication of the subject-matter of licence which is applied for

The application shall include:

  • Certified copy of a document demonstrating the applicant’s professional education in forestry
  • Affidavit that the applicant – natural person does not occupy the position of supervisor under § 21a paragraph 2 of Act No. 149/2003 Coll., and a description of the professional forestry experience acquired by the applicant indicating the number of years of practice
  • Written consent of the employer of the applicant – natural person (§ 21 paragraph 2 of Act No. 149/2003 Coll.) if the natural person is an employee who is not a supervisor of a state enterprise, government organization or a company engaged in the business of the field for which the license is issued, or an employee of the public authorities or authorized body (§ 26 and 30 of Act No. 149/2003 Coll.)
  • Administration fee (duty stamp in the amount of CZK 1,000)

A legal entity or natural person who has appointed an entrusted representative in the application shall state:

  1. The company name, address and legal form of the applicant; a natural person who has appointed an entrusted representative shall state the name and surname, date of birth and address of The place of residence or business address if different from the address of permanent residence
  2. The name, surname and address of permanent residence of the person or persons who are the statutory body of the applicant (not required of a natural person who has appointed an entrusted representative)
  3. Identification number, where available
  4. Indication of the subject-matter of licence which is applied for
  5. The name, surname, date of birth and birth index number, if assigned, place and district of birth and address of permanent residence of the entrusted representative of the applicant

The application shall include:

  • Certified copy of a document demonstrating the responsible representative's specialist education in forestry
  • Description of experience to date in forest management on the part of the representative in charge, indicating the number of years of professional practice (an affidavit)
  • Description of the present forestry experience of the responsible representative stating the number of years of experience
  • Affidavit of the applicant – natural person that he is not a supervisor under § 21a paragraph 2 of Act No. 149/2003 Coll.
  • Written consent of the employer of the applicant – natural person (§ 21 paragraph 2 of Act No. 149/2003 Coll.) if the natural person is an employee who is not a supervisor of a state enterprise, government organization or a company engaged in the business of the field for which the license is issued, or an employee of the public authorities or authorized body (§ 26 and 30 of Act No. 149/2003 Coll.)
  • Administration fee (duty stamp in the amount of CZK 1,000)

Procedure for granting a licence

  • The application shall be approved by the Ministry of Agriculture

Application clearing deadline

  • The decision on the licence shall be issued within 30 days of submission of the application; in complex cases the decision shall be issued within 60 days

Fees

  • CZK 1,000 according to the Act on Administrative fees [item No. 87(b)]

Validity period of the licence

  • Unlimited period of licence validity
