Conditions for granting a licence

Compliance with the conditions under Regulation (EC) No. 183/2005, the Feed Act and Decree No. 356/2008 Coll., implementing Act No. 91/1996 Coll., on animal feed, as amended.

Application requirements

The application for approval and registration for a feed business operator contains:

For natural persons established in the Czech Republic

  • name, or name(s) and surname
  • date of birth
  • trade name, where applicable
  • permanent residence, or any other address designated for delivering correspondence, generally at the current address in the territory of the Czech Republic or place of business
  • identification number, where available
  • address of the business, type and specification of activity

Data liable to protection of patent rights and data designated as a trade secret.

For legal entities established in the Czech Republic

  • for legal entities the trade name or name registered address, and/or any other address designated for delivering correspondence, and/or location of organisational unit in the territory of the Czech Republic
  • identification number, where available
  • address of the business, type and specification of activity

Data liable to protection of patent rights and data designated as a trade secret.

For natural persons established in a third country

  • name and surname, date of birth and contact address of the person in charge in the Czech Republic
  • address of the business, type and specification of activity

Data liable to protection of patent rights and data designated as a trade secret.

For legal entities established in a third country

  • registered address of the organisational unit in the Czech Republic or name, date of birth and contact address of the person in charge in the Czech Republic
  • address of the business, type and specification of activity

Data liable to protection of patent rights and data designated as a trade secret.

The application shall include:

  • Document attesting to the registration of the business, i.e. a trade licence, extract from the Commercial Register or certificate of entry in the registry of agricultural entrepreneurs
  • Data on the operation (see annexes to the application, depending on the requested type of activity)

Requirements connected to the provision of services by a provider from a different Member State

No special requirements associated with the provision of services by providers from another Member State have been specified.

Procedure for granting a licence

  • The application shall be approved and assessed by the Central Institute for Supervising and Testing in Agriculture.

Application clearing deadline

  • The Central Institute for Supervising and Testing in Agriculture shall issue a resolution on the licence within 30 days of the licence application being submitted

Fees

  • To be collected pursuant to Section V, item 93 of the Tariff Scale of Administrative Fees, annexed to Act No. 634/2004 Coll., on administrative fees, as amended, for the:
  1. Issue of a resolution on the approval of a production operator CZK 20,000
  2. Issue of a resolution on the conditional approval of an operator for production or marketing CZK 1,000
  3. Issue of a resolution on the approval of a marketing operator CZK 3,000
  4. Issue of a resolution on the registration of a production operator CZK 5,000
  5. Issue of a resolution on the registration of a marketing operator CZK 1,000
  6. Issue of a resolution on the registration of a forwarding operator or operator at the level of primary production CZK 100
  7. Issue of a resolution on amending the data in the application for approval or registration CZK 500

Validity period of the licence

The resolution shall be issued for an indefinite period; only in cases of so-called conditional (temporary) approval of a feed business operator it is stipulated that conditional approval must not exceed a total period of six months.

The registration or approval of an operator may be temporarily suspended where it can be demonstrated that it does not comply with the conditions applicable for its activity. Article 15 of Regulation No. 183/2005 specifies the circumstances where the operating facility may be closed.

Combined proceedings (recognising qualifications and granting authorisation)

  • The professional qualification recognition procedure shall be governed by Article 22 et seq. Act No. 18/2004 Coll., on the recognition of professional qualification and other competence of EU Member State nationals and some nationals of other countries and on amendments of certain acts (Act on the Recognition of Professional Qualification).

  • No professional liability insurance is required
