Granting, renewing and revoking authorization – conditions for obtaining them

Conditions for granting a licence

If the applicant for the grant of authorization is a natural person, the authorizing body shall grant the authorization to the applicant provided that he:

  1. has full legal capacity
  2. has a clean record
  3. proves professional eligibility corresponding to the subject professional qualification
  4. demonstrates at least 5 years experience in an occupation that requires the professional qualifications for which authorization for the subject professional qualification will be validated by other people
  5. submits an affidavit of familiarity with current developments in the field of the subject professional qualifications and occupations related to it
  6. demonstrates the provision of the material and technical prerequisites necessary for conducting tests specified in § 18 provided in the assessment standard of the professional qualifications
  7. was not declared bankrupt in the last 5 years, was not subject to insolvency proceedings, is not in liquidation, and no bankruptcy petition against the applicant was rejected for lack of assets or the proceedings were cancelled after the fulfilment of the ruling or because the applicant’s assets were insufficient to cover the costs of bankruptcy
  8. has no registered tax arrears, no arrears in insurance payments and penalties for public health insurance or for premiums and for penalties for social security and for contributions to the state employment policy
  9. requested the grant of authorization for a professional qualification, for which the qualification and assessment standard has been approved.

If the applicant for the grant of authorization is a legal person, the authorizing body shall grant the authorization to the applicant provided that it:

  1. demonstrates the provision of the material and technical prerequisites necessary for conducting tests specified in § 18 provided in the assessment standard of the professional qualifications
  2. names at least one natural person from among its members, associates, officials, members of its bodies, employees or other persons who are in an employment or other contractual relationship with it to substantiate that it meets the conditions specified in § 10 paragraph 1 letters a) to e) and who will conduct the activities of an authorized person on behalf of the applicant as an authorized representative
  3. was not declared bankrupt in the last 5 years, was not subject to insolvency proceedings, is not in liquidation, and no bankruptcy petition against the applicant was rejected for lack of assets or the proceedings were cancelled after the fulfilment of the ruling or because the applicant’s assets were insufficient to cover the costs of bankruptcy
  4. has no registered tax arrears, no arrears in insurance payments and penalties for public health insurance or for premiums and for penalties for social security and for contributions to the state employment policy
  5. the persons exercising the role of the statutory authority of the applicant or member of the statutory body of the applicant have unimpeachable integrity (§ 10 paragraph 2)
  6. requested the grant of authorization for a professional qualification for which the qualification and assessment standard has been approved

Application requirements

Requirements connected to the provision of services by a provider from a different Member State

If the applicant is not a citizen of the Czech Republic, it shall demonstrate the integrity clause by documentation equivalent to those issued by the relevant authority of the country of origin of the applicant or a country in which the applicant lived continuously for more than 3 months during the last 3 years, which is not older than 3 months. If a serious reason prevents the acquisition of equivalent documentation, an affidavit can be substituted in its place.

Procedure for granting a licence

  • The authorizing body shall decide on the grant of authorization based on the written application. The applicant has the legal right to the grant of authorization provided he meets all the requirements stipulated by the law on recognizing further education for the grant of authorization.

Application clearing deadline

  • Within 30 days from the initiation of the procedure

Fees

  • The grant of authorization is subject to an administrative fee pursuant to Act No. 634/2004 Coll., Administrative Fees
  • The fee is 1500 CZK for each professional qualification the applicant would like to have validated

Validity period of the licence

  • Authorization is granted for a period of 5 years. Its validity may be repeatedly renewed for successive terms of 5 years, based on an application submitted no later than 3 months before the expiration of the authorization. The procedure for renewing authorization is subject to the provisions of the law on recognizing further education for the grant of authorization.
