Mining activity - licencing step by step

Mining involves the search and research of reserved deposits; the opening up, preparation and mining of reserved deposits; establishing, securing and closing mine works and quarries; the modification and refinement of minerals carried out in association with mining; establishing and operating slag heaps, dumps and tailings during associated activities; special intrusions into the Earth's crust; securing and decommissioning old mines; mine rescue service and mine measuring activities.

Persons wanting to conduct mining activities must initially obtain a certificate of professional eligibility for the person in charge, which they shall be issued with upon successful completion of an examination by the Czech Mining Office, or by the competent Local Mining Authority. The applicant shall subsequently apply for authorisation to carry out such activity at the competent Local Mining Office. 

Procedure for obtaining authorisation:

  1. Application for a certificate of professional eligibility for the person in charge
  2. Application for a licence

1) Application for a certificate of professional eligibility for the person in charge

  • In the case of Mine’s expert lead, a Lead Mine Measurement Staff Member, Waste Deposition Risk Assessor, Technical Detonation Manager and Directors of Main Mining Rescue Stations, the application shall be submitted to the Czech Mining Office; otherwise the application shall be submitted to the Local Mining Office.
  • There is no prescribed form for the application.

The application shall be supplemented with:

  1. documentary proof of completed education
  2. documentary proof of work experience to date
  3. documentation of works to which the person in charge has contributed
  4. document attesting to payment of the administrative fee amounting to CZK 1,000.

The applicant shall sit an examination before an expert committee.

Upon completing the examination, the applicant may apply for the authorisation to carry out the activity.

2) Application for a licence

  • The application shall be filed with the relevant Local Mining Office.
  • There is no prescribed form for the application.

The application shall be supplemented with:

  1. certificate of professional eligibility for the person in charge (see the previous point),
  2. documentary proof of the applicant's legal existence (extract from the Commercial Register, trade licence, Memorandum or Articles of Association, etc.)
  3. document attesting to payment of the administrative fee amounting to CZK 1,000.

The authority will grant the license within 30 days.

 

The business may be conducted after fulfilling all the above stated requirements.
