A service provider wishing to provide cross-border services in the Czech Republic first has to find out whether the service he wants to provide is regulated in the Czech Republic. You can find all the regulated professions/activities in the Czech Republic in the Database of regulated professions and activities in the Czech Republic.
In case the service you want to provide is regulated in the Czech Republic, you have to notify the relevant authority which is responsible for the profession in question prior to the commencement of your business activities in the Czech Republic (you can find the contact details and addresses of the relevant authorities in the Database of regulated professions under the respective professions). The notification (which you can download here) has to include the following documents:
- Proof of the nationality of the provider (a simple copy of your passport or identity card).
- Proof that the service provider is legally established in his country of origin and that he's legally providing the service in question there (a copy of your trade license or a statement from the trade register – don't forget about the Czech translations of these documents).
- In case the profession you want to provide in the Czech Republic is regulated in your country of origin, it is recommended also to include a copy of your qualification certificate and the Czech translation thereof).
- In case the service/profession is not regulated in your country of origin but it is regulated in the Czech Republic, you should provide some proof that you've pursued the activity in question for at least two years in the course of the last ten years (copies of invoices, etc., also with a translation to Czech).
Submit the notification together with all the accompanying documents to the relevant authority. Now you may start providing cross-border services in the Czech Republic. The notification is valid for one year and after its expiry it has to be submitted again. In case there have been no major changes in the meantime, the repeated submission of the notification can be done without the accompanying documents.
In case the service you want to provide in the Czech Republic falls within the category of regulated professions which have implications for public health or safety, the relevant competent authority may check your professional qualifications prior to the first provision (this is called the verification of qualifications).
In such a case, the provider has to wait for a reply with the statement of the competent authority. The statement may be positive, negative or the authority may request the provider to take an examination. Should no statement from the authority arrive within three months, consider this as if a positive statement had been issued. You may now provide cross-border services in the Czech Republic.
If the provision of the service necessitates a permanent residence in the Czech Republic exceeding three months, the provider should register at the police and apply for a temporary residence as an EU citizen.
