The present document sets forth conditions for obtaining the licence to sample propagating material.

Conditions for granting a licence

  • the requisite qualification for professional eligibility
  • experience in checking seed crops in accordance with procedures and under official supervision

Application requirements

  • The application shall be filed using a prescribed form. This form is available in Annex 18 to Decree No. 384/2006 Coll., setting down the particulars on marketing of seed and planting material of cultivated plants

Procedure for granting a licence

  • The authorisation shall be issued by the Central Institute for Supervising and Testing in Agriculture upon submission of a written application. Before any authorisation is issued, the conditions of professional qualification and technical capability must be satisfied. The authority shall conduct an on-site investigation.

  • Within 30 days (as specified under the Code of Administrative Procedure)

  • No payment specified

Validity period of licence

  • The authorisation shall be issued for an indefinite term

Combined proceedings (recognising qualifications and granting authorisation)

  • Procedures pursuant to Act No. 18/2004 Coll., on the recognition of professional qualification and other competence of EU Member State nationals and some nationals of other countries and on amendments of certain Acts (Act on the Recognition of Professional Qualification) shall be followed when recognising professional qualification or other eligibility of Member State nationals.

Authorisation granted by expiration of deadline period

  • Yes, these proceedings are subject to the rule that a licence shall be automatically granted to applicants upon expiry of the deadline period

The wording of all of the above provisions is based on Council Directive 2004/117/EC of 22 December 2004 amending Directives 66/401/EEC, 66/402/EEC, 2002/54/EC, 2002/55/EC and 2002/57/EC as regards examinations carried out under official supervision and equivalence of seed produced in third countries.
