Some activity in the area of arms and ammunition – licencing step by step

The activity consists of the development and manufacture of arms, the repair and modification of arms; in particular, removing arms defects and changing their characteristics to order. The licence includes the performance of maintenance, the assembly and adjustment of arms and their transportation to a specified destination. Further, the purchase, sale, and rental of arms, their storage, keeping and the due care of arms accepted into custody. Disabling and destroying arms. The same applies to ammunition.

Applicants wanting to carry on the permitted trade must obtain the decision granting the trade permit from a trade licence office. The trade permit is granted following a written application. The Ministry of Industry and Trade shall express its opinion regarding the application.

Application for a license

The application shall be submitted:

  1. at any trade licence office
  2. via public administration contact points (the so-called Czech POINT) – in Czech only
  3. electronically, via the information system provided by the Register of Trade Business

The application may only be submitted using the so-called Standard Registration Form.

The application shall be accompanied by material demonstrating professional qualification. In this case, it means:

for the development, manufacture, repair, modification, disabling, and destruction of arms:

  1. higher education in a study programme and field focusing on technical sciences or technology and 3 years’ experience in the profession, or
  2. further vocational education in a field of study focusing on technical sciences or technology and 3 years’ experience in the profession, or
  3. secondary education with a school-leaving examination in a field of study with a technical focus and 3 years’ experience in the profession, or
  4. secondary education with a certificate of apprenticeship in a field of study for a gunsmith or toolmaker and 3 years’ experience in the profession, or
  5. a retraining certificate or other evidence of professional qualification for the relevant employment activity, issued by an establishment accredited in accordance with specific legislation, or by an establishment accredited by the Ministry of Education, Youth and Sports, or by a ministry in whose purview the sector in which the trade is operated falls, and 4 years’ experience in the profession;

for the purchase, sale, transportation, rental, and storage of arms and ammunition:

  1. higher education in a study programme and field focusing on economics, the military, the police, technical sciences or technology and 1 year’s experience in the profession, or
  2. further vocational education in a field of study focusing on economics, the military, the police, technical sciences or technology and 2 years’ experience in the profession, or
  3. secondary education with a school-leaving examination in a field of study with a technical, economic, military or police focus and 2 years’ experience in the profession, or
  4. secondary education with a certificate of apprenticeship in a field of study to be a shop assistant specializing in arms and ammunition or in a related field and 3 years’ experience of business activity involving arms and ammunition, or
  5. secondary education with a certificate of apprenticeship in a field of study to be a gunsmith or toolmaker and 3 years’ experience in the profession or 1 year’s experience of business activity involving arms and ammunition, or
  6. a retraining certificate or other evidence of professional qualification for the relevant employment activity, issued by an establishment accredited in accordance with specific legislation, or by an establishment accredited by the Ministry of Education, Youth and Sports, or by a ministry in whose purview the sector in which the trade is operated falls, and 4 years’ experience in the profession;

for the manufacture, repair, modification, disabling, and destruction of ammunition:

  1. professional competence stipulated for the development, manufacture, repair, modification, disabling, and destruction of arms, a pyrotechnic authorization or certificate, and age of at least 21 years;

for the development of ammunition:

  1. higher education in a study programme and field focusing on technical sciences or technology, the field of explosive theory and technology, and 3 years’ experience in the profession;

for the acquisition of explosives, and explosive objects and the performance of activities involving explosives, the entrepreneur or the entrepreneurs responsible representative shall comply with the professional competence stipulated for the research, development, destruction, disabling, processing, purchase and sale of explosives consistent with the scope of the trade licence for development, manufacture, destruction and disabling of ammunition. 

Entrepreneurs and members of statutory boards must also demonstrate their integrity.

Integrity in this case is demonstrated by a background check under the Act 451/1991 Coll. The background check report is issued by applying to the Ministry of Interior of the Czech Republic. Background check reports certify that during the period from 25 February 1948 to 17 November 1989 the person being screened was or was not:

  • a member of a national security unit assigned to State Security
  • registered as a collaborator in State Security archives

This obligation does not apply to citizens born after 1 December 1971. These citizens are not required to submit background checks or affidavits.

If all requirements have been met, the Trade Licensing Office will issue a decision on the application for a license within 30 days of receipt of the application at the local Trade Licensing Office. If the license is granted, the Trade Licensing Office will register it in the Trade Licensing Register within 5 days from the date of granting the license and issue a certificate to the business.

The business may be conducted after fulfilling all the above stated requirements.
