What do you need when solving the service electronically

Completed trademark application form filed in a way that allows verification of your identity (e.g. by using a data box or by sending an electronically signed document via e-mail). 
The application form can also be submitted classically via e-mail (without e-signature). In this case, however, it is necessary to confirm the submission by its subsequent delivery within 5 days of thereof. This can be done using the data box, by sending electronically signed document, but also in person.
 

Where and how to solve the service electronically

The application shall be submitted to the Industrial Property Office. It can be submitted electronically directly via the e-filing application:

It is also possible to file by data mailbox (address: ix6aa38) or e-mail (posta@upv.gov.cz). In the case of using e-mail without electronic signature, however, it is necessary to confirm the submission by its subsequent delivery within 5 days. The fee for electronically processed service

The fee for the submission of application is as follows:

• Individual trademarks within three classes of products or services - CZK 5,000,
• Collective and certification trademarks within three classes of products or services - CZK 10,000,
• For each class of products or services above three classes - CZK 500.

Classes of products and services may be accessed using TMclass.

Fees can be paid in cash at the Office’s cash register, by value stamps (fees up to CZK 5,000 only), transfer from account or money order to account no. 3711- 21526001/0710.

The trademark application number shall be indicated by: O, a dash and a serial number. The application file number is automatically assigned by the Office upon the receipt of the trademark application.

The constant symbol is 1148, the variable symbol is made up of the number 3 and the number of the application file.

For O-8516 the variable symbol is: 38516, for O-141141 the variable symbol is: 3141141.

The fee must be paid within 1 month of filing the application, otherwise the application is deemed not to have been filed. The Office does not send any formal request for payment of the fee.

Fee reduction

The Office will reduce fees specified in the Law 634/2004 Coll., on administrative fees as follows:

Fees for procedure before the Office will be automatically reduced by 20% (with the maximum fee reduction being CZK 1,000) provided legislative requirements are met. In simplified terms, the fee reduction is applied if:

1. The form is submitted using the Office's online system (e-filing)
2. User has logged in via Digital identity (which is possible by using Bank ID, eGovernment mobile key etc.)
